Same-Day Draft Delivery for Urgent Estate Planning
When time is short, our office offers expedited estate planning document drafting. For most basic estate plans, you can receive same-day delivery of drafts for a transparent, flat rush fee. Each client works directly with an attorney, and every rush order comes with a one-page Signing Checklist that explains how to properly execute documents under North Carolina law.
Important note: Rush drafting does not guarantee in-office signing. You should plan to print your documents and sign them with your own notary and qualified witnesses. We provide clear instructions, so you understand the legal requirements.

What Documents Qualify for Same-Day Service?
Same-day delivery is available for many essential estate planning documents. This includes:
- Will Package (Will, General Power of Attorney, Health Care Power of Attorney, Living Will, HIPAA Authorization)
- Revocable Trust Package (Trust, Pour Over Will(s), Powers of Attorney, Living Will, HIPAA Authorization)
- Revocable Trust (stand-alone)
- Simple Will (stand-alone)
- Powers of Attorney (financial or health care)
- Living Will or HIPAA Authorization
Irrevocable trusts, Special Needs Trusts, complex tax-driven plans, and deed recording or retitling require additional time. These are typically available on a three-business-day priority basis.
How the Same-Day Process Works
Our same-day estate planning service follows a clear process:
- Call or book a consultation online and let us know it’s a rush.
- Complete intake and pay the invoice. If received by 3:00 p.m. ET on a business day, drafts are typically delivered that day. Later requests are delivered the next business day.
- Attorney review takes place, and you receive instructions plus a one-page checklist.
- Execute (sign) your documents following North Carolina witness and notary requirements.
- Submit one round of quick revisions within 7 days, if needed.
Our legal team is here to help guide you through the process.
How to Sign Correctly Under North Carolina Law
To help ensure your estate planning documents are legally valid, each rush package includes a detailed, step-by-step Signing Checklist.
Below is a summary of the key signing requirements for common documents in North Carolina:
- Will — This document must be signed in the presence of two competent adult witnesses who also sign. A notary is not required but adding a self-proving affidavit before a notary simplifies probate.
- General Power of Attorney — This document must be acknowledged before a notary, with no witnesses required.
- Health Care Power of Attorney — This document must be signed in the presence of two qualified adult witnesses and a notary.
- Living Will — This document requires two qualified adult witnesses and a notary.
Practical tip: Many banks and UPS-type locations in North Carolina offer notary services. We recommend using disinterested adult witnesses, and we provide guidance on qualifications and a suggested script.
Remote & Electronic Signing Options in North Carolina
North Carolina law permits certain electronic notarization and witnessing methods. However, these options remain limited. They include:
- In Person Electronic Notarization (IPEN) — This method is allowed but still requires physical presence with the notary.
- Remote Electronic Notarization (REN) — This method is authorized with strict limits. REN cannot be used for self-proved wills, trusts, or codicils.
- Emergency Video Notarization (EVN) — This method is currently authorized until July 1, 2026, or until licensed REN platforms are issued.
For urgent matters, printing and signing with an in-person notary and qualified witnesses is usually the most reliable option. If travel or medical issues require remote execution, we advise case by case based on current North Carolina law.
Common Questions About Same-Day Estate Planning
What counts as same-day?
If intake and payment are received by 3:00 p.m. ET on a business day, drafts are sent that day. Later submissions are typically delivered the next business day.
Can you provide notary and witnesses?
Rush service does not guarantee in-office signing. Most clients use a nearby notary and bring two qualified witnesses.
Do you record deeds same-day?
We can draft on a rush basis. Recording timelines depend on your county clerk’s office.
Can everything be signed by video?
Sometimes, but not always. Certain remote options exist, but restrictions apply, especially for wills and trusts. We advise based on the type of document and current rules.
