Guardianship in North Carolina & How to Avoid It

When an adult becomes incapacitated without powers of attorney in place, a family member or other interested party may need to petition the court to obtain legal authority to manage that person’s affairs. In North Carolina, guardianship petitions are filed in the special proceedings division of the clerk of superior court in the county where the respondent resides. For Wake County residents, that means the Wake County Clerk of Superior Court.

The process involves a hearing, a guardian ad litem appointed to represent the respondent’s interests, and a judicial determination of incompetency before a guardian is named. Depending on the findings, the guardianship may be full or limited based on the person’s remaining decision-making capacity. The proceeding takes time and carries legal costs that families hadn’t budgeted for.

A valid financial power of attorney and a health care power of attorney, signed while the person still has legal capacity, can reduce or eliminate the need for court-supervised guardianship. We draft these documents with that goal in mind, giving our clients’ families a clear path forward without relying on the courts to sort it out.
