Minor Trust Attorney in Raleigh
Helping Raleigh Families Choose the Right Inheritance Vehicle for Their Children
A minor's trust can allow parents to place an inheritance under the management of a trustee rather than having the child receive the assets outright upon reaching adulthood. Depending on how it is structured, a trust can establish rules for how and when funds are used and can continue for a period specified in the trust document.
A minor's trust can be incorporated into a will or living trust, or established through a separate trust arrangement. It may be particularly useful when parents want to provide for a child while retaining greater control over how inherited assets are managed and distributed.

Common Reasons Raleigh Parents Set Up a Minor’s Trust
Parents often establish a minor’s trust when they want more control over how an inheritance is managed and distributed to a child.
Common reasons Raleigh families consider a minor’s trust include:
- Life insurance and retirement accounts: When a minor is named as a beneficiary, the proceeds may require a custodial or court-supervised arrangement rather than being managed directly by the child. Naming an appropriately structured trust as the beneficiary can provide a framework for managing and distributing those assets according to the parent's instructions.
- Conditional gifts: Grandparents and other relatives may use a minor’s trust when they want an inheritance to be managed for a specific purpose, such as education, healthcare, or other needs. Depending on the arrangement, a trust can provide greater flexibility than a UTMA custodial account, which generally terminates when the beneficiary reaches the applicable statutory age.
- Blended families: When parents have children from different relationships, a trust can provide specific instructions about which beneficiaries receive particular assets and when. Clearly documented instructions can help reduce uncertainty and provide a structured plan for administering the inheritance.
What Happens When There’s No Plan for a Minor’s Inheritance
When a minor is named to inherit assets and no trust or custodial arrangement is in place, a court must appoint a property guardian to manage the funds until the child turns 18. That process runs through the Clerk of Superior Court, with ongoing supervision and formal accountings required throughout. In Raleigh and the rest of Wake County, those proceedings are handled at the Wake County Courthouse.
The Clerk can hold certain funds for a minor’s benefit up to a set limit per source without opening a full guardianship, but that option has caps and doesn’t give you any control over how or when the funds are used. Either way, the child may still receive everything outright at 18 with no conditions attached.
